Who is the service for certifying communications sent to customers via Whatsapp for?

The certification service is aimed at all professionals who need to send messages with legal value to their clients. In particular, it is very useful for lawyers who have to send communications that cannot be contested like a registered letter with acknowledgment of receipt. 

What are the conditions for which it has legal value

In order for messages sent via Whatsapp to be given legal value, one of two conditions must exist:

  • the message must be read by the recipient through the appearance of the double blue tick 
  • The recipient has replied to the message he received, even though the content sent to him has only the gray double check, with no color, which still means it was delivered.

What can be certified

You can certify any type of content, from text to images/videos, from an audio file to an attachment of any format. (.docx, .pdf, .zip)

How soon it is possible to carry out the certification

There is no time limit. If the message is present in the phone from which it was sent, we can always carry out the certification, via the cloud or by sending the device. However, in order to reduce costs and times, it is necessary to proceed through faster authentication, remote authentication, which uses whatsapp web. 

We therefore ask you to verify that the messages to be authenticated are visible not only on the telephone but also on the web version of Whatsapp, since if they are not, we have two alternatives, the first of which is to acquire the chat via the cloud backup and the second by physically sending the device without SIM, by courier.

Find a guide here [ click here ] on how to CONNECT A DEVICE on whatsapp web  and carry out the required verification. Then you need to connect to this URL  https://web.whatsapp.com/ and check if your chats are present. If you have an old version of the whatsapp APP on your phone, do not update to the new version and proceed to the required check first. If the web version of whatsapp does not show the messages you wish to acquire then we will provide you with a new quote starting from verifying the possibility of proceeding via the cloud backup and if this is not possible by sending the phone.

To make sure we can find messages on whatsapp web, we recommend proceeding with authentication no later than 10 days after sending . After this date there is the possibility that whatsapp no ​​longer shows online messages but requests the device.

How the service is structured

First you need to define the following parameters to get a quote:

  1. The total number of chats (chats=customers) per week or in a month, which you expect to acquire, in slots of up to 50 chats at a time (for example, if you think you need to acquire 150 communications a month sent to 150 customers, the acquisition sessions will be 3, one every ten days and 50 chats each)
  2. The maximum number of consecutive messages for each chat (max 5 messages, max 10 messages, max 20 messages, max 50 messages) 
  3. Where to save the data (if on personal google drive or request our storage space)
  4. What type of report is required (simple with essential data, or customized and more accurate. Both still have the same legal value)
  5. The minimum length of service (1 month, 3 months, 6 months, 1 year)

Note: for a large number of communications it is advisable to purchase a dedicated number to use whatsapp for this purpose only.

Once the quote has been accepted:

  • the customer will send to our studio by email, one day before the date agreed for the acquisition session, a list with the telephone numbers and associated names and the dates of the messages to be certified (eg: number: 3771151946; name: emanuel concealo ; messages : from 12 January to 14 January.
  • the days of the week or of the month in which our operator will have to connect remotely for the acquisitions will be agreed. For each session, access to whatsapp web is required which will only take 10 minutes of your time. Once the connection to whatsapp web has been obtained, we will carry out the work independently. Please note that whatsapp web access is not phone access and that none of your phone data will be available to us. Furthermore, for the contents that we will acquire, we declare maximum confidentiality as per our privacy policy and confidentiality agreement.
  • Acquisitions with accompanying reports will be deposited on your or our gdrive. A folder will be created that we will name with the phone number and the date of acquisition (for example, if the phone number is 3771151946 and we are in January, the gdrive folder will be named as follows “3771151946-15-january-20xx” ) and we will provide you at the end of each session with the list with direct links that can be sent to your customers to view the evidence material. Each gdrive folder will therefore have access with an encrypted link, so anyone with this url will be able to view the documents present.
